Enclosed with this memorandum is the eighth report detailing applications for waivers and modifications of mandates contained in the School Code and administrative rules. This report contains 52 waiver applications that are subject to review and consideration by the General Assembly. In addition, two appeals of determinations made by the State Board are included in the report. The appeals concern charter schools and eligible applicants. I believe the two appeals merit serious review and recommend that you disapprove these. A description of each of the appeals follows:

Application WM199-1113-1(A) submitted by Elk Grove Township Community Consolidated School District 59 (Cook). The district is appealing the State Board's determination that its original request to waive Section 27A-9(f) of the School Code pertaining to charter school funding is ineligible since the statutory requirement is a directive to the State Board and not a mandate on the school district.

In June 1998, the State Board of Education reversed the local school board's decision not to approve a charter for the Thomas Jefferson Charter School. In doing so, the State Board became the chartering entity for that school. The State Board thus became responsible for following the directive (set forth in Section 27A-9(f) of the School Code) to provide per-pupil funds to the charter school by diverting them from funds otherwise due the district.

The school district, however, submitted a request for a waiver from Section 27A-9(f). The agency determined that this request was ineligible for consideration because the relevant provision of the School Code does not constitute a mandate on the school district but rather instructions to the State Board. The district is appealing this determination.

The State Board recommends that the General Assembly deny this appeal. To do otherwise would effectively nullify the avenue of appeals now available to charter school developers whose applications are denied at the local level. Charter schools that are chartered by the State Board on appeal must have a source of funding, so that to negate the mechanism provided in Section 27A-9(f) would be tantamount to negating their ability to operate. This would obviously be inconsistent with the intent underlying the Charter Schools Law.

Application WM399-1128(A) submitted by Sangamon Area Special Education District (Sangamon). The district is appealing the State Board's determination that special education cooperatives are ineligible to apply for waivers under Section 2-3.25g of the School Code.

The General Assembly in fall 1997 denied two appeals from special education cooperatives that had submitted waiver requests, indicating that the cooperatives were not eligible to submit requests under the law. The waiver law explicitly states that only school districts and independent authorities established when the state intervenes in a failing school district are eligible to apply for waivers and modifications.

In submitting the first appeals from special education cooperatives to the General Assembly, the State Board asked that body to make a determination on the eligibility of entities other than school districts and independent authorities to submit waiver and modification requests. The General Assembly clearly said other entities are not eligible under the law as currently written. While the Sangamon Area Special Education District was informed of the General Assembly's action, it challenged that decision by submitting an appeal. Under the waiver law, the State Board has an obligation to submit all appeals to the General Assembly. In order to maintain consistency with the statutory intent, the State Board urges the General Assembly to continue to deny petitions from ineligible applicants.

The report also includes a request addressing a topic that the General Assembly has not previously considered. One school district is seeking to permit its current principal to assume the position of district superintendent without having acquired the necessary two years of administrative experience required for the superintendent endorsement. While this request would affect administrative certificate requirements, it is being sent to the General Assembly since it does not appear to violate the waiver law's prohibition against requests addressing teacher certification.

In addition, the report includes two requests to waive the requirement in Section 21-9 of the School Code pertaining to the number of days a substitute teacher can teach during the school year. The General Assembly has dealt with this issue four times in the past: it approved three such requests in spring 1997 and fall 1998 and disapproved a similar request submitted in spring 1998. The teachers' unions believe that such requests address teacher certification, an area that is not eligible for consideration under the waiver law. While the General Assembly denied one of these requests, it failed to make a determination that such requests constitute teacher certification issues. Therefore, the State Board is obligated to continue to send these applications to the General Assembly.

I hope this information will be helpful to you as you begin the process of reviewing the latest set of waivers requested by schools. The response to the waiver law shows that districts will continue to seek ways to enhance their programs and services to meet the individual needs of their students and communities.

Also included are summaries of requests for waivers and modifications acted on by the State Board of Education and of applications that have been returned to school districts or other applicants.

Executive Summary

 

The following report outlines waivers of School Code mandates that school districts have requested since the last report, which was transmitted in September 1998. Pursuant to Section 2-3.25g of the School Code (105 ILCS 5/2-3.25g), these requests must be sent to the General Assembly for its consideration before May 1.

The report is organized by subject area and by school district. The General Assembly may disapprove the report in whole or in part within 30 calendar days after each chamber next convenes once the report is filed. This is done by a joint resolution. If either chamber fails to reject a waiver request, then that request is deemed granted.

Section I summarizes the 52 requests received for waivers of School Code mandates for consideration by the General Assembly, which are presented alphabetically by topic area. The largest number of applications received seeks waivers from Section 27-6 of the School Code regarding the requirement for daily physical education (14 requests). In one instance (Warren CUSD 222 on page 6), the school district is proposing that physical education become an elective course at the high school level. The General Assembly has both approved and denied similar requests.

The report also contains two requests addressing topics that the General Assembly has not previously considered. One school district is seeking to permit its current principal to assume the position of district superintendent without having acquired the necessary two years of administrative experience required for the superintendent endorsement (see page 1 of the report). While this request would affect administrative certificate requirements, it is being sent to the General Assembly since it does not appear to violate the waiver law's prohibition against requests addressing teacher certification. In the second request, a district would like to extend the maximum lease term of school property from 25 years to 50 years (see page 2 of the report). The General Assembly may wish to review both of these requests to determine whether they are in keeping with the intent of the waiver law, given their indirect connection to school improvement.

Eleven school districts submitted requests seeking relief from the limitation of administrative costs established in Section 17-1.5 of the School Code. P.A. 90-653, effective July 29, 1998, allows a school district to submit such a request only when the circumstances for exceeding the cap are beyond the control of the district and when the district has exhausted all available remedies to comply with the law. The waiver application must specify the amount, nature, and reason for the relief requested, as well as all the remedies the district has exhausted in its attempt to comply with the 5 percent limitation. (The State Superintendent of Education has recused himself from consideration of WM198-1090-1 due to past service in the district).

Four other districts submitted applications addressing limitation of administrative costs. Two of these requests were returned because the districts would qualify to waive the cap by a two-thirds vote of their respective boards, and two were withdrawn since the districts could not identify specific reasons for the requested relief.

The report includes two requests to waive Section 21-9 of the School Code pertaining to the number of days a substitute teacher can teach during the school year. Oak Lawn CHSD 218 and Prairie-Hills ESD 144 (see page 9 of the report) seek to employ substitute teaching staff in any one school year for more than the 90-day limit established by statute. This is being called to the General Assembly's attention since it may address certification issues. Teacher certification laws and rules cannot be the subject of waivers or modifications under Section 2-3.25g of the School Code. Previously, the General Assembly approved three such requests (in spring 1997 and fall 1998), but it disapproved a similar request submitted in spring 1998.

Section II of the document includes two appeals of determinations made by the State Board of Education (see page 11 of the report). One district has appealed the State Board's determination that its request pertaining to charter school funding is ineligible since the statutory requirement is a directive to the State Board not a mandate on school districts. A special education cooperative submitted the second appeal. In returning the request as ineligible, the State Board relied on the General Assembly's decision in Senate Joint Resolution 28, adopted November 12, 1997, that "special education cooperatives are ineligible to apply for waivers under the existing language of Section 2-3.25g of the School Code." The special education cooperative's request addressed the number of days for which a substitute teacher could be employed in a school year.

This document also contains three additional sections beyond what is required under Section 2-3.25g of the School Code. Section III of the report lists the 79 requests for modifications or waivers of State Board of Education rules and modifications of School Code mandates that the State Board has approved pursuant to authority granted to it in Section 2-3.25g. Section IV describes 14 requests that have been returned to or withdrawn by the petitioning entities.

Section V shows all the requests submitted, organized by Senate and House district. In addition, the requests received are summarized by subject area in a table following this Executive Summary. Complete copies of the waiver requests for the General Assembly's consideration have been made available to legislative staff.

This is the eighth report submitted pursuant to Section 2-3.25g of the School Code, which requires that the State Board of Education compile and submit requests for waivers of School Code mandates to the General Assembly before May 1 and October 1 of each year.

WM199-1134 - Waiver of School Code (Section 21-7.1(e)(4)) request to allow the current principal to serve as the district superintendent even though he lacks the required two years of administrative experience for the superintendent's endorsement.

Palatine CCSD 15 - Cook / Expiration: 2002-03 school year

WM198-1088 - Waiver of School Code (Section 24A-5) request to allow the district to eliminate the required ratings for the teacher evaluation program and replace them with ratings of "meets district standards" or "does not meet district standards." The district also requests to extend the evaluation cycle from two years to three years for those teachers who elect to develop professional growth plans.

Antioch CHSD 117 - Lake / Expiration: 2003-04 school year

WM199-1149-2 - Waiver of School Code (Section 27-23) request to allow the district to charge a reasonable fee not to exceed $300 of students who participate in driver education courses.

Rockford PSD 205 - Winnebago / Expiration: 2003-04 school year

WM199-1167-3 - Waiver of School Code (Section 27-23) request to allow the district to charge a reasonable fee not to exceed $110 of students who participate in driver education courses.

General State Aid and Average Daily Attendance Calculations

Rockford PSD 205 - Winnebago / Expiration: 2002-03 school year

WM199-1167-2 - Waiver of School Code (Section 18-8.05(F)(1) and Section 18-8.05(F)(2)(a)) request to allow the district to count the attendance of students enrolled full time in much the same way as the attendance of students enrolled part time is counted, claiming 1/6 day for each class period of at least 50 minutes attended by a student (up to a maximum of six classes per day).

Niles SD 71 - Cook / Expiration: 2002-03 school year

WM399-1193 - Waiver of School Code (Section 10-22.11(c)) request to allow the district to increase the maximum lease term from 25 years to 50 years in order to stimulate growth in the community and provide greater revenue to the district.

Length of School Term

Granite City CUSD 9 - Madison / Expiration: 1999-00 school year

WM199-1172(renewal) - Waiver of School Code (Section 10-19) request to allow the district to adopt a school calendar that is shorter than the required 185 days specified in Section 10-19 of the School Code. This would be accomplished by eliminating emergency days and lengthening the remaining school days proportionate to the number of emergency days the district used during the school year, regardless of whether all five emergency days have been taken.

Limitation of Administrative Costs

Pecatonica CUSD 321 - Winnebago / Expiration: 1998-99 school year

WM198-1089 - Waiver of School Code (Section 17-1.5) request to allow the district to waive the limitation of administrative costs due to circumstances beyond its control. The district maintains that actual administrative expenditures for FY98 were at a reduced level due to the employment of an interim superintendent. Documentation by the district indicates that by using FY97 administrative expenditures and increasing this amount at a rate of 5 percent annually, the proposed FY99 administrative expenditures would not exceed the legislatively mandated cap.

Deerfield PSD 109 - Lake / Expiration: 1998-99 school year

WM198-1090-1 - Waiver of School Code (Section 17-1.5) request to allow the district to waive the limitation of administrative costs due to circumstances beyond its control. The district has experienced a steady growth in enrollment (5.4 percent per year over the last 11 years) that has necessitated additional support services and personnel. In addition, health insurance premiums have increased 18 percent due to market conditions and claims. (The State Superintendent of Education has recused himself from consideration of this request due to past service in the district).

Braceville ESD 75 - Grundy / Expiration: 1998-99 school year

WM198-1092 - Waiver of School Code (Section 17-1.5) request to allow the district to waive the limitation of administrative costs due to circumstances beyond its control. The district needs to employ an additional bookkeeper to assume the duties of the permanent bookkeeper, who is on a leave of absence due to severe illness.

Raccoon CCSD 1 - Marion / Expiration: 1998-99 school year

WM198-1103 - Waiver of School Code (Section 17-1.5) request to allow the district to waive the limitation of administrative costs due to circumstances beyond its control. During the 1997-98 school year, the superintendent served as principal and transportation administrator, with a portion of his salary and benefits being charged to the Transportation Fund. For the 1998-99 school year, a principal was hired who will serve as the transportation administrator. Therefore, 100 percent of the superintendent's salary is now budgeted to the Education Fund, causing the increase to exceed the 5 percent cap.

St. Joseph-Ogden HSD 305 - Champaign / Expiration: 1998-99 school year

WM199-1107-2 - Waiver of School Code (Section 17-1.5) request to allow the district to waive the limitation of administrative costs due to an excess in a line item (Executive Administrative Services) on the administrative cost worksheet that is beyond its control. In 1997-98, the district hired an interim superintendent, which it shared with another district, at a salary level that was significantly less than half of what it was paying its previous superintendent, who was employed full time. In order to retain that individual, the district increased his salary to an amount that is still less than half of the previous superintendent's salary. In addition, the district has had to budget for the purchase of two new copiers to be used by both its instructional and administrative staff.

Joliet PSD 86 - Will / Expiration: 1998-99 school year

WM199-1152 - Waiver of School Code (Section 17-1.5) request to allow the district to waive the limitation of administrative costs due to circumstances beyond its control. In 1997-98, the district received grant funds and was able to hire several new employees for its technology program. These employees, however, only worked for a portion of that school year, so the expenditure for salaries was lower than the amount budgeted for 1998-99. In addition, the district hired an instructional supervisor to oversee staff development tied to implementation of the Illinois Learning Standards.

Barrington CUSD 220 - Lake / Expiration: 1998-99 school year

WM199-1158 - Waiver of School Code (Section 17-1.5) request to allow the district to waive the limitation of administrative costs due to unfilled or under-filled positions that have now been filled. In addition, the district erroneously reported certain special education and administrative costs in the previous year, causing the 1998-99 increase to exceed the 5 percent limit.

Brooklyn USD 188 - St. Clair / Expiration: 1998-99 school year

WM199-1164 - Waiver of School Code (Section 17-1.5) request to allow the district to waive the limitation of administrative costs due to circumstances beyond its control. Due to the inability of the district to find a replacement principal late in the 1997-98 school year, the superintendent assumed the duties of the principal. In the 1998-99 school year, a full-time principal and an interim superintendent were hired, which will cause the district's costs to increase beyond the 5 percent limit.

Peoria PSD 150 - Peoria / Expiration: 1998-99 school year

WM199-1166 - Waiver of School Code (Section 17-1.5) request to allow the district to waive the limitation of administrative costs in order to fund an assistant superintendent's position. The need to establish the position was identified in a 1994 independent review, but the position was not filled until the 1998-99 school year.

Rockford PSD 205 - Winnebago / Expiration: 1998-99 school year

WM199-1167-4 - Waiver of School Code (Section 17-1.5) request to allow the district to waive the limitation of administrative costs due to a federal desegregation lawsuit that requires it to budget expenditures which are not within its control. Compliance with the federal desegregation order requires staffing allocations for specified positions, causing costs to increase beyond the 5 percent cap.

Pleasant Valley SD 62 - Peoria / Expiration: 1999-00 school year

WM199-1182(renewal) - Waiver of School Code (Section 17-1.5) request to allow the district to waive the limitation of administrative costs. The renewal will allow the district to continue implementation of a policy enacted in 1993 that provides for raises of 10 percent each year for up to three years preceding the retirement of a full-time staff member who has been employed by the district a minimum of 25 consecutive years. This will affect the salary of the district superintendent for the next two years. The district maintains that since this is a contractual issue, it creates circumstances beyond the control of the district and prevents it from staying with the 5 percent limitation.

Non-Resident Tuition

Rankin SD 98 - Tazewell / Expiration: 2003-04 school year

WM199-1154-1 - Waiver of School Code (Section 10-20.12a) request to allow the district to charge 54 percent of its per-pupil tuition to those students who are not residents of the district. The waiver would allow the district to attract a sufficient number of students to maintain its enrollment and offer regular instruction without combining grades.

 

Parent-Teacher Conferences

Beach Park CCSD 3 - Lake / Expiration: 2002-03 school year

WM198-1080 - Waiver of School Code (Section 18-8.05(F)(2)(d)(1)) request to allow the district to dismiss classes one hour early four times during the school year in order to schedule three-hour-long parent-teacher conferences in the evening of each early dismissal day, and to count these days as full days of pupil attendance.

Rockton SD 140 - Winnebago / Expiration: 2003-04 school year

WM399-1115-1 - Waiver of School Code (Section 18-8.05(F)(2)(d)(2)) request to allow the district to schedule four, three-and-one-half-hour-long evening parent-teacher conferences in lieu of two full days for conferences. Each evening conference would be scheduled after a full day of pupil attendance and would be counted as a half day of attendance.

Gibson City-Melvin Sibley CUSD 5 - Ford / Expiration: 2003-04 school year

WM399-1132-1 - Waiver of School Code (Section 18-8.05(F)(2)(d)(1)) request to allow the district to schedule parent-teacher conferences in the evening following full days of student attendance twice in a five-day period and to count those evening conferences as one day of pupil attendance. One day during that week would be a non-attendance day for students and staff.

Murphysboro CUSD 186 - Jackson / Expiration: 2001-02 school year

WM199-1141-2 - Waiver of School Code (Section 18-8.05(F)(2)(d)(1)) request to allow the district to schedule four evening parent-teacher conferences for the high school, to accommodate its 4-block schedule, and to count those four conferences as two of the 176 days of attendance required pursuant to Section 10-19.

Carterville CUSD 5 - Williamson / Expiration: 2001-02 school year

WM199-1177 - Waiver of School Code (Section 18-8.05(F)(2)(d)(1)) request to allow the district to schedule two separate evening parent-teacher conferences after regular full days of school. The two conferences will be counted as one full day of pupil attendance, with the day following the final conference scheduled as a non-attendance day for students.

Physical Education

Warren CUSD 222 - Warren / Expiration: 2003-04 school year

WM198-1087-1 - Waiver of School Code (Section 27-6) request to allow the district to provide physical education activities to students in grades kindergarten through 6 for 30 minutes twice a week due to inadequate facilities.

WM198-1087-3 - Waiver of School Code (Section 27-6) request to allow the district to provide physical education activities on less than a daily basis to students in grades 7 and 8 who are academically at risk, in order to provide extended Title I reading and math services for up to five periods per week.

Warren CUSD 222 - Warren / Expiration: 2003-04 school year

WM198-1087-4 - Waiver of School Code (Section 27-6) request to allow the district to provide physical education as an elective course for those students in grades 9 through 12. Students who choose to take physical education will have their grades included in their grade point averages, something not currently done.

St. Joseph-Ogden 305 - Champaign / Expiration: 2003-04 school year

WM398-1107-1 - Waiver of School Code (Section 27-6) request to allow the district to exempt students in grades 9 through 12 from the daily physical education requirement in order to take additional academic classes.

Southern CUSD 120 - Henderson / Expiration: 2003-04 school year

WM199-1147 - Waiver of School Code (Section 27-6) request to allow the district to provide physical education activities to students in grades 5 through 8 four days per week, to enable them to attend a computer orientation and instruction class one day per week.

Fremont SD 79 - Lake / Expiration: 2003-04 school year

WM199-1148-2 - Waiver of School Code (Section 27-6) request to allow the district to provide physical education activities to students in grades kindergarten through 8 on alternate days due to inadequate facilities.

Morton CUSD 709 - Tazewell / Expiration: 2003-04 school year

WM399-1155(renewal) - Waiver of School Code (Section 27-6) request to allow the district to provide physical education activities to students in grades kindergarten through 6 twice a week due to inadequate facilities and limited personnel.

Grayslake CHSD 127 - Lake / Expiration: 2003-04 school year

WM199-1157 - Waiver of School Code (Section 27-6) request to allow the district to exempt students in grades 11 and 12 from the daily physical education requirement if they participate in pompons and meet the qualifications set by the district.

Rockford PSD 205 - Winnebago / Expiration: 2003-04 school year

WM199-1167-1 - Waiver of School Code (Section 27-6) request to allow the district to waive the daily physical education requirement for the following reasons: (a) to allow middle school students to take physical education classes as an elective in order to enroll in fine arts, music, foreign language, vocational/career education or technology; (b) to allow students in grades 9 through 12 to enroll in the above-mentioned courses, including advanced placement classes or to repeat coursework needed for graduation; and (c) to excuse students in grades 9 through 12 from physical education activities if they participate in interscholastic athletics, cheerleading, pompons, gymnastics or ice skating.

Marquardt SD 15 - DuPage / Expiration: 2003-04 school year

WM199-1168-1 - Waiver of School Code (Section 27-6) request to allow the district to provide physical education activities to students in grades kindergarten through 5 for 30 minutes a day during a two-week period due to inadequate facilities.

Orion CUSD 223 - Henry / Expiration: 1999-00 school year

WM399-1174(renewal) - Waiver of School Code (Section 27-6) request to allow the district to exempt students in grades 10 through 12 from physical education activities if they participate in a sport not sponsored by the school, provided that they have a high degree of athletic ability; have a practice schedule of at least 15 hours per week that affects school work; have hired a coach; and have a possibility of receiving a college scholarship. Parents must seek approval from the local board of education in order for the students to be excused.

Pleasant Plains CUSD 8 - Sangamon / Expiration: 2003-04 school year

WM199-1176 - Waiver of School Code (Section 27-6) request to allow the district to exempt students in grades 9 through 12 from the daily physical education requirement for two out of the four years of high school so that they can participate in other courses and extracurricular activities.

Wauconda CUSD 118 - Lake / Expiration: 2003-04 school year

WM399-1184 - Waiver of School Code (Section 27-6) request to allow the district to exempt students in grades 9 through 12 from physical education activities if they continuously participate in cheerleading and pompons.

Glencoe SD 35 - Cook / Expiration: 2003-04 school year

WM399-1194 - Waiver of School Code (Section 27-6) request to allow the district to provide physical education activities to students in grades 1 through 8 four days per week instead of daily. Kindergarten students will be provided physical education activities one time per week for 25 minutes.

 

School Improvement/Inservice Training

St. Charles CUSD 303 - Kane / Expiration: 2003-04 school year

The district requested to be allowed to permit students in grade 10 (Centennial High School) to participate in physical education activities/health and wellness for three quarters and safety education (driver's education) for one quarter, which is already allowable under Section 1.440(a).

WM199-1131-1 - Waiver of School Code (Section 18-8.05). The district requested to be allowed to amend their school calendar to replace a Teacher Inservice training day with a student attendance day for March 26, 1999, only, which can be amended by the local board.

WM199-1173 - Waiver of School Code (Section 18-8.05(F)(2)(d)(2)). The district requested permission to use banked time to allow certain portions of days of attendance at one high school to be used for staff development activities related to the school's school improvement plan. This arrangement conforms to Section 18-8.05(F)(2)(d)(2) of the School Code, and no waiver is needed.

In 1997-98, the district hired an interim superintendent, which it shared with another district, at a salary level that was significantly less than half of what it was paying its previous superintendent, who was employed full time. In order to retain that individual, the district increased his salary to an amount that is still less than half of the previous superintendent's salary. In addition, the district has had to budget for the purchase of two new copiers to be used by both its instructional and administrative staff.
