The Paul Douglas Teacher Scholarship is a federally- funded program for outstand¬ ing high school students pursuing teaching careers. The award provides up to $5,000 each academic year. Deadline for freshmen is August 1. The Illinois Women in Law Enforcement association is offering a $300 scholarship for fall to IWLE members or the daughter or son of a full-time or retired Illinois police or law enforcement officer. The deadline to apply is September 1. To receive an application for either scholarship, contact MCC's Financial Aid Office at (815) 455-3700, Ext. 261. Let's Talk Real Estate By Orville Brettman, Broker So you started out to buy the house, and you put your money on the line and the contract was drawn. What happened to your $5,000? If the listing broker did his job according to the letter of the law, the money went into something called a trust account. It went into the brokers trust account within 24 hours of acceptance of the contract by the seller, and will remain there until closing. At closing it will be removed from the trust account and become a credit to the buyer. But...oh woe is me, the deal is crumbling, closing time has come and for any one of a great bunch of ugly reasons the deal can't or won't close. What does the Broker do with the earnest money? Well, gang...when a broker holds earnest money given by the buyer at the presentation of a contract he is really acting as the escrow agent for both parties, the buyer and the seller. In the event of a dispute. often the contract will detail how the earnest money must be divided. The broker can not act as an arbitrator or judge to determine which party is in default, or consequently how the funds are to be dispersed. In a default situation, the broker must hold the earnest until a mutual agreement is reached, or until a court order is entered which directs the broker to releeise the money, and details the manner of its disposition. Depending on who caused the default and how close to closing it occurred it is possible that the broker may be entitled to a commission and this issue should also be addressed in the courts before earnest money is released from the trust account. Fortunately, these issues are rare, but they do cause much unpleasantness when they occur.
