June 4tli by a jury of 4 men and 8 women of re¬ sisting arrest. The trial wan heard in Judge Brodys Courtroom at the McHenry County Courthouse. Mr. O'Grady, attorney for Mr. EmesU, staid te would appeal tte verdict. Mr. Emesti was charged with run- jang a stop sign and resa.<*ing arrest on tte morning of January 26, 1974 in tte area of tte Green Diamond Restaurant in Huntiey, At a previous trial, Mr. Emesti was found Not Guilty of tte Stop Sign Violation by a jury of 12. This charge led to tte Inddents which resulted in tte re- sistkig arrest charge. Aooording to testimony p«eserted at tte trial. Officers McKeating and Stolquist had juSt finished break¬ fast at tte Green Diamond Restaur¬ ant and bad gone to (he squad car. Officer St<^quiist was inside of tte car wbBe Officer McKeating was outside. Officer McKeating stated (hat te observed Mr. Ernesti run (te stop sign at Dwyer Street and Rt 47 prioir to pulUiv into tte Oreen DUmvood lot Officer Stol^iist stated that te ^d not see Mr. Seaarti run .(to ftar a^ ta<t. flat Observed Uta }n tte reendew mknot aa he entered the Ofeen DlcnMttKi parking kit Offioer McKeating said that te teiied Mr. Elmesti several ttee*. with statemerAs such as "Excise me, sir" and "Wait a mlnite, I want to talk to you.'' Officer Mc¬ Keating said ttet te apprehended Mr. Ernesti in tte vestibule of the Green Diamond and tapped him on tte shoulder and told him "Hold it, I want to talk to y<Mi." Wiere- upon, he said, fknestl isming with his right arm in a cdrde toward him. he officer said te jumped tedt blocked tte blow and attempted to smib^hie Emesti. The offioer said that Mr. Emesti then took a second Swing at him. Office- Stolquist, who reportedly was oorfside the building arrived at (*iis time and assisted officer Mc Keating with Mr Ernesti to the squad car. According to testimony given by officer McKeating, Mr. Emesti cffli- tiniied to istruggle with the police after te was advised he was under arrest on the way to the squad cor. There wore several descrepancies tol, Offijoer MoKeatilng testimony which conflicted with other witness, es and his own police report. In ttet report the officer stated that Mr. Emesti's oar was parked several car lengths south of tte entrance of the Green Diamond Reertauiant. In his testimony te stated ttet the Emesti car was parked several oar lenghts north of (te enfcranoe. All of the other witnesses stated ttiat the oar -was parked in tte first parking place from tte doorway betiween 5 - 10 feet from the en- tronoe. In Ms report, (Micer M&. Keating .stated that Mr, Emesti had only swung <Hioe at him. Wten atted which repont was right. Officer Mc Keating stated that his testimony in court was accurate.
