Minutes Of The Village Board Meeting The Regular Meeting of the Village Board of Trustees was held on Thursday, March 9, 1989, in the Board Room of the Village Hall and called to order at 8:00 P.M. by President Dhamer. Present were President Dhamer, Trustee Wicke, Borowicz, Brown, Greve, and Hoeft. Also attending were Attorney Kukla and Village Engineer Schwegel. The first order of business was the Public Hearing held for the purpose of hearing from any or all of the owners of the 15 parcels for possible annexation to the village; these parcels being completely surrounded by the village boundaries. Attorney Kukla conducted said hearing noting that all legal publications and notice procedures had been met. He advised that 2 of the 15 parcels had not been included at this point. He also made note that under Section 7-1-13 of the Statutes of Illinois the village could force annex by merely notification to any property less than 60 acres and completely surrounded by village boundaries. He asked for any comments or questions from the audiences: 1) Ralph Berlin - Wanted to be sure that the village is aware that Parcel A of Tract B which was published in the notice was already in the village and has been and is taxed. Attorney Kukla recognized this after checking further, prior to the hearing. 2) Peter Mugavero: He objected to being forced annexed but would like the option of annexing voluntarily and inquired relative to his zoning which by the County is M-1. Attorney Kukla said he would automatically be zoned as RE 1 but if he was using the property as M 1 it would remain with the property unless abandoned for six months which it would then change to RE 1. If he was not using M 1 zoning, in order to maintain the M 1 zoning he would then have to file a petition to rezone to M 1 from RE 1. Mr. Mugavero said he wanted more information. 3) Mrs. McCampbell: Questioned if she would have any say regarding this annexation. She was answered that it is a village board decision. She felt she was not completely surrounded; however Board showed map which did surround her property. 4) Terry Todd: Questioned how far south the boundaries were, and if the Ervin property was annexed. He was advised that they were and again the map was shown. 5) Clete Starr: He was advised that he could annex by going through the proper legal channels of the village. He also questioned the sewer hook up fees since he has a septic system and he was told he probably would not have to hook up unless his system failed, but the village could require. It is their option. 6) Phil Freund: His business has been zoned for business for 25 years. Attorney Kukla gave him the same advice he had given Mr. Mugavero. He asked procedure regarding annexing voluntarily and Attorney Kukla gave him options. 7) Art Kahl: Stated he had 13 acres east of the Ervin property and would not like to annex. 8) Carolyn Jones: She asked whether they had any choice to annex and whether the village would annex one or all or none of the parcels. Attorney Kukla said this was a Board decision only. 9) Janet Starr: Asked if their taxes would include the S T P expansion expense. She was told this is only charged to users of the facility. President Dhamer questioned Mrs. McCampbell as to why she was objecting since the village had put paved street, curb and gutter, past her property with the Board noting that she had to use public right of way which was in village to get to her property. She started that it will cost her more in taxes. With this Attorney Kukla closed the Public Hearing to resume the agenda of the Regular Meeting. He told the Board he had not notified the two parcels before mentioned but that it can be deferred to the April regular meeting. After discussion, it was determined to table any action on the annexation matter to the April 13 meeting. The minutes of the February 9, 1989 meeting were before the trustees. Before they were approved. Trustee Greve found an error regarding the vote on the Galanis zoning matter in which it should have read 2/3 vote and not 1/3 as typed. Thereafter, Trustee Greve made a motion to accept the minutes as corrected, seconded by Continued on page is
