JUSTICE BOWMAN delivered the opinion of the court:
On October 12, 2005, plaintiff, Time Savers, Inc. (TSI), filed its third amended complaint
alleging the following five counts against defendant, LaSalle Bank, N.A. (LaSalle): (1) violation of
the Illinois Fiduciary Obligations Act (Fiduciary Obligations Act) (760 ILCS 65/1 et seq. (West
2004)); (2) breach of contract; (3) common-law fraud; (4) conspiracy to defraud; and (5) aiding and
abetting. LaSalle moved to dismiss TSI's third amended complaint, pursuant to section 2--615 of
the Code of Civil Procedure (Code) (735 ILCS 5/2--615 (West 2004)), and the circuit court granted
that motion with prejudice on January 25, 2006. TSI timely filed its notice of appeal, and we affirm.
