The parties of record before the Property Tax Appeal Board are Javier Rodriguez, the appellant, by attorney Julie Realmuto of McCarthy & Duffy, Chicago, Illinois; and the Cook County Board of Review.
The subject property is improved with an 86-year old, two-story style dwelling of masonry construction containing 2,056 square feet of living area with a full, finished basement, two full baths, and a two-car garage.
The appellant's appeal is based on unequal treatment in the assessment process. The appellant submitted information on three/four/five comparable properties described as one and one-half story or two-story frame, masonry or frame and masonry dwellings that are from 75 and 90 years old for consideration. Located in the same assessment neighborhood as the subject, the comparables contain from 1,862 to 2,530 square feet of living area and have improvement assessments ranging from $4.76 to $7.65 per square foot of living area. The subject's improvement assessment is $9.71 per square foot of living area. Based on this evidence, the appellant requested a reduction in the subject's improvement assessment.
The board of review submitted its "Board of Review Notes on Appeal" wherein the subject's final assessment was disclosed. The board of review presented descriptions and assessment information on three comparable properties consisting of two-story masonry dwellings that range in age from 76 to 79 years old. The dwellings are located in the same assessment neighborhood as the subject. The dwellings range in size from 2,080 to 2,328 square feet of living area and have improvement assessments ranging from $8.82 to $10.01 per square foot of living area. Based on this evidence, the board of review requested confirmation of the subject's assessment.
