THE STATE OF ILLINOIS
THE PEOPLE OF THE STATE OF ILLINOIS, Appellee, v. BRIAN
Opinion filed December 17, 2009.
JUSTICE GARMAN delivered the judgment of the court, with
Chief Justice Fitzgerald and Justices Freeman, Thomas, Karmeier,
and Burke concurred in the judgment and opinion.
Justice Kilbride dissented, with opinion.
Following a jury trial in October 2006, in the circuit court of Will
County, defendant, Brian Nelson, was convicted of 16 counts of first
degree murder (720 ILCS 5/9–1(a)(1), (a)(2), (a)(3) (West 2002)),
four counts of home invasion (720 ILCS 5/12–11(a)(1) (West 2002)),
and four counts of aggravated arson (720 ILCS 5/20–1.1(a)(1) (West
2002)). The jury found death to be the appropriate sentence on the
murder convictions and the circuit court of Will County imposed a
sentence of death on those convictions. The court sentenced defendant
to concurrent prison terms of 30 years on the home invasion and
aggravated arson convictions.
