ORDER
By the Commission:
On November 12, 2009, and pursuant to Section 4-204 of the Public Utilities Act, the Illinois Commerce Commission Corporation (“Commission”) entered a Citation Order initiating the instant proceeding against GEF Technologies, LLC (“Respondent”), a telecommunications carrier as defined in Section 13-202 of the Public Utilities Act, based on its failure to maintain corporate status. A Staff report recounts the Secretary of State’s notice that the Respondent’s certificate of authority to operate in the State of Illinois was revoked for failure to file an annual report and pay an annual franchise tax. On this basis, the Order directed Respondent to appear at the offices of the Commission in Chicago, Illinois, to show cause why the Commission should not rescind its certificate of service authority or take other appropriate action.
Pursuant to notice given in accordance with the law and the rules and regulations of the Commission, this matter came on for hearing before a duly authorized Administrative Law Judge of the Commission at its offices in Chicago, Illinois on January 21, 2010. Respondent did not appear. Counsel for Commission Staff appeared and recommended that Respondent’s certificate of service authority be revoked on basis of the record, which includes notice from the Secretary of State that the Respondent has lost its authority to transact business in Illinois. At the conclusion of the hearing, the record was marked “Heard and Taken”.
The Commission, having considered the entire record herein and being fully advised in the premises, is of the opinion and finds that the certificate of service authority granted to the Respondent should be cancelled and revoked because the Respondent is no longer qualified to operate as a foreign corporation in the State of Illinois. There is no evidence to the contrary.
