Introduction:
On February 25, 2009, the Illinois Commerce Commission (“Commission”) entered an Order Commencing Reconciliation Proceedings, which directed North Shore Gas Company (“North Shore” or “Respondent” or “Company”) to present evidence in this docket at a public hearing to show the reconciliation of revenues arising under its Rider 11, Adjustment for Incremental Costs of Environmental Activities, of Respondent’s Schedule of Rates and the actual costs prudently incurred and recoverable under Rider 11 for the twelve months ended December 31, 2008.
Pursuant to notice duly given as required by law and by the rules and regulations of the Commission, an evidentiary hearing was held before a duly authorized Administrative Law Judge of the Commission at its offices in Chicago, Illinois, on April 13, 2010. Appearances were entered by the Respondent and by the Commission Staff. Respondent presented pre-filed sworn testimony of Steven J. Matuszak, Retired Manager of Remediation and Compliance for North Shore and Brian F. Bartoszek, Manager of Remediation and Solid Waste for North Shore. Staff presented pre-filed sworn testimony of Daniel G. Kahle of the Commission’s Accounting Department, Financial Analysis Division. The record was subsequently marked “Heard and Taken.”
At the conclusion of the hearing, the parties advised the Administrative Law Judge that they had resolved all matters in controversy and did not file briefs. The parties requested leave to file a Draft Proposed Order for the Administrative Law Judge’s consideration. The Administrative Law Judge granted the request.
