ORDER

I. Introduction
On November 1, 2010, Vanguard Energy Services, LLC (“Applicant” or "Vanguard ") filed a verified Application with the Illinois Commerce Commission requesting a certificate of service authority as an Alternative Gas Supplier (an “AGS”) in Illinois pursuant to Section 19-110 of the Public Utilities Act (220 ILCS 5/19-110) (“the Act”), and 83 Ill. Adm. Code 551.10 et seq.
On October 28, 2010, notice of the application was published in the official state newspaper pursuant to Section 19-110(c) of the Act and Section 551.30(a). After receiving notice of various deficiencies from Commission Staff, the Administrative Law Judge (“ALJ”) on November 22, 2010, issued a ruling requiring Vanguard to provide additional information required under Section 19-110 and under Part 551, so that certain deficiencies could be corrected and certain information in the Application could be clarified. On November 30, 2010, Vanguard filed an Amended Application including attachments. As set forth below, this response fully met the conditions contained in the ALJ ruling. Vanguard should be issued an AGS certificate.
II. Statutory Authority
Unless an entity has been certificated as an AGS to provide utility or utility-related services, it cannot provide those services. The statutory provisions applicable to the certification of AGSs are set forth in Section 19-110 of the Act. Section 19-110(a) applies only to Alternative Gas Suppliers that serve, or seek to serve, residential or small commercial customers. As is set forth herein, Section 19-105 of the Act specifically defines the customers who are eligible for AGS service. (220 ILCS 5/19-105).
