I. PRELIMINARY MATTERS
On September 10, 2010, Constellation NewEnergy, Inc. (“Applicant” or "NewEnergy”) filed a verified application with the Illinois Commerce Commission (“Commission”) requesting an amendment of its certificate of service authority as an alternative retail electric supplier (“ARES”) in the State of Illinois pursuant to Section 16-115 of the Public Utilities Act (“Act”), 220 ILCS 5/1-101 et seq., and 83 Ill. Adm. Code 451 (“Part 451”). Applicant submitted its certificate of publication showing that on September 15, 2010, proper notice of the application was published in the official State newspaper. On September 16, 2010, Applicant filed a supplemental application providing information that was inadvertently omitted from the application. The Administrative Law Judge requested clarification of certain matters contained in the application. Applicant filed a verified response to the Administrative Law Judge on October 4, 2010.
II. BACKGROUND AND AUTHORITY SOUGHT BY APPLICANT
Applicant was initially granted a certificate of service authority to operate as an ARES in Illinois in Docket No. 99-0447. Such certificate has been amended twice in Docket Nos. 03-0325 and 06-0601. Applicant is currently authorized to offer the sale of power and electricity to eligible nonresidential retail customers with annual electrical consumption greater than 15,000 kilowatt-hours, as well as single-billing services in the service areas of Commonwealth Edison Company ("ComEd"), Central Illinois Light Company d/b/a AmerenCILCO, Central Illinois Public Service Company d/b/a AmerenCIPS, and Illinois Power Company d/b/a AmerenIP.
In the current proceeding, Applicant seeks authority, in addition to its existing authority, to offer the sale of power and electricity to all eligible retail customers, including residential customers, in the service area of ComEd.
