Governor Signs Childhood Hunger Relief Act
On February 15, 2005 Governor Rod Blagojevich signed the Childhood Hunger Relief Act
requiring more Illinois schools to implement a breakfast program. House Bill 756, sponsored
by Rep. Susana Mendoza (D-Chicago) and Sen. Miguel del Valle (D-Chicago), stipulates that all
schools in which at least 40% of the students are eligible for free or reduced-price lunches must
also provide a breakfast meal. The new law, effective immediately, requires the board of education
of each school district to determine within 90 days and then each school year thereafter which
schools in their district would fall within the 40% threshold based on data submitted to the
Illinois State Board of Education (ISBE) and operate a School Breakfast Program. Provisions are
included in the law to allow a school district to opt out of the breakfast program under certain
circumstances. The new law also encourages districts in which 50% or more of the students qualify
for free or reduced lunch to offer a Summer Food Service Program by 2006.
